House panel OKs tax provision of bill pushing for reform in PCG

The House ways and means committee on Monday approved the tax provision of  the measure seeking to provide administrative reform and reorganization of the Philippine Coast Guard (PCG).

The substitute bill to House Bills 4286 and 4287, providing for the administrative reform and reorganization of the PCG, revising for the purpose Republic Act 9993, otherwise known as the PCG Law of 2009, was approved during a panel meeting led by Albay Representative Joey Salceda.

The panel approved without amendments the tax provisions of the measure under Section 6 (f), which includes the following:

  • Section 52. Exemption from Attachment and Taxes – Retirement benefits granted by this Act, including benefits received from a duty instituted provident fund and mutual benefit association shall not be subject to attachment, levy, execution or any tax of whatever nature;
  • Section 54. Collection of Revenues – The PCG shall collect fees, dues, charges, and fines relevant to the exercise of its various functions: Provided, that the 30% shall be credited to the special account; and
  • Section 57. Implementing Rules and Regulations – For submission to the Secretary of Transportation for approval, the Philippine Coast Guard, not later than 120 days from the effectivity of this Act, shall issue rules and regulations, determine, fix/and or prescribe charges, rates, and penalties, as may be necessary to implement its provisions, as well as the provisions of laws, issuances, decrees and orders related to the implementation of PCG functions.

Zambales Representative Cheryl Deloso-Montalla, author of House Bill 4287, stressed that the present law which revitalized PCG “contains certain ambiguous provisions which deter the PCG from achieving its optimum potential.”

Deloso-Montalla also said recent developments in the maritime sector necessitates a re-visit of the existing PCG law so that it could become more responsive to the issues at present.

She said the bill she is pushing seeks to define the powers of the PCG’s key officers, categorize its personnel, appropriately classify their ranks, define their qualifications and tenure, provide a framework for their disciplinary system through an internal affairs service, provision of legal assistance, and prescription of retirement benefits, among others. — Anna Felicia Bajo/RSJ, GMA News
